Law Enforcement Guidelines

This page is for law enforcement officers seeking records from Cosmix. It explains where to send a request, what legal process we require, and how we handle emergencies, preservation, and notice to our users.

Cosmix is operated by CosmicPairing in the State of North Carolina, United States.

Nothing here is legal advice, and nothing here waives any right or objection available to us or to our users, including as to jurisdiction, venue, or the sufficiency of service.

1. Where to send a request

Send requests to info@cosmixpairing.com, with Law Enforcement Request in the subject line.

For an emergency involving a risk of death or serious physical injury, write to safety@cosmixpairing.com with Emergency Disclosure Request in the subject line. That inbox is watched for safety matters and is the faster of the two.

Email from an official government domain is the quickest route and the one we prefer. Accepting a request by email does not waive any objection, including as to proper service of process.

2. What to include

A request we can act on identifies the account and the records sought. Please include:

  • The requesting agency, the officer's name, badge or ID number, official email address, and a direct phone number.
  • A case or reference number.
  • The legal process, attached, signed, and issued by a court or authority with jurisdiction.
  • The account, identified precisely. The email address on the account is best. A display name alone is usually not enough to identify one account with confidence.
  • The specific records sought, and the date range they cover.
  • The date by which you need a response, and whether a nondisclosure order applies.

Requests that do not identify an account well enough for us to be certain which one is meant will come back to you with a question rather than with records.

We are a United States provider, and we require valid United States legal process.

  • Basic subscriber records, meaning the information a person gave us to open and hold an account, require a subpoena or other valid legal process.
  • Non-content records about an account require a court order or a search warrant.
  • Content, which includes messages between users and photographs uploaded to a profile, requires a search warrant issued on probable cause.

Foreign law enforcement should proceed through a Mutual Legal Assistance Treaty, a letter rogatory, or another recognized channel that produces United States legal process. Emergencies are the exception, and are handled as described below.

We review every request for legal sufficiency and for scope. We object to or narrow requests that are overbroad, vague, or unlawful, and we say so rather than producing more than the process supports.

4. Emergency disclosure requests

Where we believe in good faith that an emergency involving a risk of death or serious physical injury to any person requires disclosure without delay, we may disclose the information needed to address that emergency, as permitted by 18 U.S.C. § 2702(b)(8).

An emergency request should come from an official government email address and should state:

  • The nature of the emergency and the person at risk.
  • Why the records sought will help address it, and why there is no time for legal process.
  • The account, identified as described above.
  • The specific records needed, limited to what the emergency requires.

If a person is in immediate danger, contact emergency services first. We cannot dispatch help, and a request to us is not a substitute for one.

5. Preservation requests

We honor properly made preservation requests under 18 U.S.C. § 2703(f). We will preserve the records available at the time we receive the request for 90 days, and for a further 90 days on request while you obtain legal process.

Preservation holds the records as they stand. It does not disclose them, and it does not restore anything already deleted before the request arrived.

6. Notice to our users

Our policy is to notify a user before we produce their records, so that they may seek to protect their interests, unless:

  • We are prohibited from giving notice by law or by court order.
  • We believe on reasonable grounds that notice would create a risk of harm to a person, or would risk the destruction of evidence or the flight of a suspect.
  • The request is an emergency of the kind described above.
  • The account is one we have already banned for conduct involving the sexual exploitation of a child.

If you need notice withheld, say so in your request and include the order or the legal basis.

7. Child safety

We have zero tolerance for child sexual exploitation, and we do not wait to be asked. Where we find child sexual abuse material or conduct that endangers a minor, we ban the account, preserve it and its contents, and report to the National Center for Missing and Exploited Children (NCMEC), which forwards to the appropriate authorities. Our Child Safety Standards Policy sets that out in full.

Officers working a CyberTipline report should reference the NCMEC report number, which lets us match it to the account and its preserved contents immediately.

8. What records exist

Our Privacy Policy describes what we collect. In short, an account may hold the name, email address, and demographic details a person gave us, the date, time, and place of birth used to build their chart, profile photographs, messages exchanged with other users, and the reports and blocks involving the account.

Payments are processed by Apple, Google, and Stripe rather than by us. We hold a record that a subscription exists, not card numbers or bank details. Those requests go to the payment provider.

We cannot produce records we do not have, and we will tell you plainly when that is the answer.

9. Authenticating records

On request, we will provide records with a certificate of authenticity suitable for use under Federal Rules of Evidence 803(6) and 902(11). Please ask when you send the request rather than afterward.
